TPS Work Permit Guidance Remains Country-Specific

USCIS has posted country-specific TPS guidance for Haiti, Syria, Ethiopia, Burma/Myanmar, Somalia, South Sudan, and Yemen. Some TPS-related Employment Authorization Documents in categories A12 or C19 are currently being treated as extended by court order, depending on the country and the card’s printed expiration date.

The current Form I-9 and E-Verify placeholder dates are July 17, 2026 for Syria, Burma/Myanmar, Ethiopia, Somalia, South Sudan, and Yemen, and July 24, 2026 for Haiti. These dates are not long-term guarantees. They may change quickly as courts and DHS take additional action, which can create confusion for both employees and employers.

TPS holders should keep copies of their EADs, TPS notices, pay records, and the current USCIS country page that applies to them. Employers should review the applicable USCIS guidance before reverifying or ending employment and should ask whether the employee has another valid List A or List C document before making an employment decision. Affected workers should seek advice if an employer questions their work authorization or if TPS is their only current immigration protection.
